1. Objective and responsible body

This Privacy Policy clarifies the nature, scope and purpose of the processing (including collection, processing, use and consent) of personal information contained in our online offering and the related websites, features and content (collectively referred to as “online offer” or “Website”). The privacy policy applies regardless of the domains, systems, platforms, and devices (such as desktop or mobile) on which the online offering is being run.

The term “user” includes all customers and visitors of our online offer. The terms used, such as “Users” are to be understood gender-neutral.

2. Basic information on data processing

We only process users’ personal data in compliance with the relevant data protection regulations in accordance with the requirements of data minimization and purpose limitation (see Processing Principles: EU GDPR Article 5). This means that the data of the users are processed only in the presence of a legal permit or obligation, for the fulfillment of contractual obligations (which are necessary, for example, for the provision of the services offered) or in the presence of your consent.

We take organizational, contractual and technical security measures in accordance with the state of the art to ensure that the provisions of the data protection laws are complied with and in order to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

Insofar as data transmission to third parties is necessary for the fulfillment of legal requirements, the fulfillment of the services to be provided within the framework of contractual obligations or on the basis of your explicit consent, we always ensure that this is done safely and in accordance with data protection regulations and in accordance with EU GDPR Article 5.

5. Cookies & reach measurement

Cookies are information transmitted from our web server or third-party web servers to users’ web browsers and are stored there for later retrieval. The use of cookies in the context of pseudonymous range measurement is described in this privacy policy.
The usage of this online offer is also possible with the exclusion of cookies. If users do not want cookies stored on their computer, they are asked to disable the option in their browser’s system settings. Saved cookies can be deleted in the system settings of the browser. 6. Integration of services and content of third parties

It may occur that contents or services of third-party providers, such as maps or fonts from other websites, are included in our online offer. The inclusion of content from third-party providers always requires that third-party providers perceive the IP address of the users, since they could not send the content to the users’ browser without the IP address.

The IP address is therefore required for the presentation of this content. Furthermore, providers of third-party content can set their own cookies and process users’ data for their own purposes. In the process, user profiles can be created from the processed data. We do our best to use this content in a data-saving and data-avoiding manner as far as possible and select reliable third-party providers with regard to data security.

The following presentation provides an overview of third-party providers as well as their contents and links to their privacy statements, with further details on the processing of data and partly revocation possibilities (so-called opt-out):

7. Use of our webshop

(1) If you want to order in our web shop, it is necessary for the conclusion of the contract that you provide your personal data, which we need to process your order. Mandatory data necessary for the processing of contracts are marked separately, further data are voluntary. We process the data provided by you to process your order. For this purpose we can pass on your payment data to our house bank. The legal basis for this is Art. 6 para. 1 p. 1 lit. b DSGVO. You can voluntarily create a customer account, through which we can save your data for further purchases at a later date. When you create an account under “My account”, the data you provide will be stored revocably.

(2) We are obliged by commercial and tax law to store your address, payment and order data for a period of ten years. However, after two years we will restrict the processing, i.e. your data will only be used to comply with the legal obligations.

(3) To prevent unauthorised access by third parties to your personal data, in particular financial data, the ordering process is encrypted using TLS technology.

8. Data protection provisions when using external payment service providers

We offer several payment methods for the use of the webshop and use different payment service providers. Depending on which payment method you choose, different data is transmitted to the respective payment service provider. The legal basis for the transmission is Art. 6 para. 1 sentence 1 lit. a DSGVO. Below we list our payment service providers.

PayPal

If you choose the payment method PayPal or Paypal Plus (purchase by direct debit / credit card), your personal data will be automatically transmitted to PayPal. Prerequisite for using the payment method PayPal is the opening of a PayPal account. When using the payment method direct debit/credit card via PayPal Plus no PayPal account is necessary.

With the use of the payment service provider PayPal or the opening of a PayPal account, name, address, telephone number, e-mail address, IP address or other data necessary for payment processing must be transmitted to PayPal. This also includes personal data related to the order itself such as the invoice amount and taxes. The legal basis for the transmission of data is article 6 paragraph 1 lit. a DSGVO (consent) and article 6 paragraph 1 lit. b DSGVO (processing for the fulfilment of a contract).

9. Security in case of abuse

If someone tries to defraud you and us with your credit card or PayPal account, please follow the instructions of your credit card company or PayPal and notify us immediately at info@unicare.berlin or from a German landline at +49 (0)30 63 41 56 03. Most credit card companies or PayPal or Klarna cover all damages you incur due to misuse of your credit card or PayPal account under certain conditions.

10. Collection and use of data for contract processing and opening a customer account

We collect personal data when you voluntarily provide us with this information as part of your order, when contacting us (e.g. via contact form or e-mail) or when opening a customer account. Which data is collected can be seen from the respective input forms. We use the data you provide us with for the purpose of contract processing and handling your inquiries. After complete processing of the contract or deletion of your customer account, your data will be blocked for further use and deleted after the expiry of the tax and commercial law retention periods, unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are legally permitted and about which we inform you below.

11. Data transfer for contract fulfilment

In order to fulfil the contract, we will pass on your data to the service company commissioned with processing the order and to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods. For the processing of payments, we will pass on the necessary payment data to the credit institution commissioned with the payment and, if applicable, to the payment service provider commissioned by us or to the payment service selected by you in the ordering process.

12. Use of data for postal advertising and your right of objection

In addition, we reserve the right to store your first and last name, your postal address, your e-mail address and – insofar as we have received this additional information from you within the scope of the contractual relationship – your title, academic degree, year of birth and your professional, industry or business designation in combined lists and to use them for our own advertising purposes, e.g. to send you interesting offers and information on our products by post or e-mail. 13. Children

Our offer is basically directed at adults. Persons under 18 years of age should not transmit any personal data to us without the consent of their parents or legal guardians.

14. Participation in competitions

Through our social media channels and our website, we regularly offer you the opportunity to participate in various competitions.

The data you provide when taking part in such a competition will only be collected, processed and used by us to carry out the competition. If the competition is carried out with a cooperation partner, it may be necessary to pass on your data to the cooperation partner for the purpose of processing the competition and distributing the prize. Any further transfer of data to third parties or use of the data for marketing purposes (e.g. for sending newsletters) will only take place if you have given your express consent in advance.

15. User rights and deletion

Users have the right, upon request, to receive information free of charge about the personal data that we have stored about them.
In addition, users have the right to correct inaccurate data, revoke consent, block the processing and delete their personal information if justifiable and to file a complaint with the responsible regulatory authority in the event of unlawful processing.

The data stored with us are deleted as soon as they are no longer necessary for their purpose and the deletion does not conflict with any statutory storage requirements.

16. Use of Google Analytics / Google ADS

(1) This website uses Google Analytics + Google Ads, web analysis services of Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, in the event that IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on the website activities and to provide further services to the website operator in connection with the use of the website and the Internet.

(2) The IP address transmitted by your browser within the framework of Google Analytics is merged with other data from Google.

(3) You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the available browser add-on.

(4) This website uses Google Analytics with the extension “_anonymizeIp()”. This allows IP addresses to be processed in a shortened form, thus excluding the possibility of personal references. If the data collected about you contains a personal reference, this is immediately excluded and the personal data is therefore deleted immediately.

(5) We use Google Analytics to analyse and regularly improve the use of our website. We can use the statistics obtained to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has subjected itself to the EU-US Privacy Shield. The legal basis for the use of Google Analytics is Art. 6 para. 1 sentence 1 lit. f DSGVO.

17. Processors

We use external service providers (order processors), e.g. for the dispatch of goods, newsletters, order processing or payment transactions. A separate order data processing agreement has been concluded with the service provider to ensure the protection of your personal data.
